Terms of Service

By accessing or using the Services, you agree to these Terms of Service (“Terms”) and to our Privacy Policy (collectively, the “Agreement”). If you do not agree, do not use the Services.

We may update these Terms from time to time; the “Effective Date” shows the latest version. Continued use constitutes acceptance of changes.

You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you may use the Services only with consent of a parent or legal guardian.

By using the Services, you represent that you meet these requirements and have authority to enter into this Agreement.

You may need an account to access certain features as tools roll out. Keep your credentials confidential and do not share them.

You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use.

We take strong measures to protect accounts but cannot guarantee absolute security.

Demorats is committed to lawful, non‑violent civic engagement.

To keep people safe:

‍No doxxing (posting or threatening to post private or identifying information about others) under any circumstance.

‍No incitement or threats of violence, terrorism, or property destruction.

‍No harassment, hate speech, or targeted abuse based on protected characteristics.

‍No glorification of real‑world harm, extremist propaganda, or illegal activity.

‍Respect anonymity. You may participate anonymously. Requests for another person’s identity or attempts to unmask them are prohibited.

‍Report safety issues. Use available report tools or contact us at [mail@demorats.org].

We may remove content, restrict features, or suspend/terminate accounts that violate these standards.

“User Content” means text, images, video, audio, code, links, and other material you submit or make available via the Services.

‍Ownership. You retain ownership of your User Content.

‍License to Demorats. You grant Demorats a worldwide, non‑exclusive, royalty‑free license to host, store, reproduce, modify (for formatting, moderation, and technical purposes), translate, adapt, publish, publicly perform, publicly display, and distribute your User Content in connection with operating, improving, promoting, and archiving the Services, including derivative works as necessary for functionality (e.g., thumbnails, transcodes, captions).

‍License to Others. Where features enable sharing, you also grant other users the right to access and use your User Content through the normal operation of the Services and subject to these Terms.

‍Moral Rights. To the extent permitted by law, you waive and agree not to assert any moral rights or rights of attribution against us for permitted technical edits or contextual placements.

‍Representations. You represent that you have all rights necessary to grant these licenses and that your User Content does not infringe or violate any law or third‑party right.

‍Feedback. If you submit ideas, proposals, or suggestions (“Feedback”), you grant us a perpetual, irrevocable, worldwide, royalty‑free license to use them without restriction or compensation.

We may (but are not obligated to) monitor or review User Content and accounts. We reserve discretion to remove, limit, or refuse content or access that violates the Agreement or applicable law.

We may block or filter content to protect safety and service integrity.

You agree not to:

Use the Services for any unlawful purpose, including violating assembly, election, campaign finance, lobbying, or public order laws.

Harass, stalk, threaten, or exploit others; doxx; or encourage self‑harm.

Impersonate any person or entity or misrepresent your affiliation (parody/satire must be clearly labeled).

Upload viruses, malware, or engage in phishing, scraping (except as allowed by robots.txt or written permission), or security bypasses.

Interfere with or disrupt the Services or their infrastructure.

Use automated systems to create accounts or content without permission.

Infringe IP rights, privacy, or publicity rights.

Collect or process personal data of others without a lawful basis and consent, where required.

We are not a law firm and do not provide legal advice.

You are solely responsible for complying with all laws that apply to your activities, including but not limited to: public assembly, protest permitting, campaign finance, lobbying registration and reporting, electioneering communications, data protection, consumer protection, and charitable solicitation. Seek legal counsel as needed.

Participation in in‑person activities carries inherent risks (e.g., crowd conditions, weather, transit, law enforcement interactions).

You acknowledge that you participate voluntarily and at your own risk, and you agree to take reasonable precautions (e.g., know local laws, follow lawful instructions, carry needed supplies).

Demorats does not control third‑party events or venues and is not responsible for conditions or outcomes there.

To the fullest extent permitted by law, you release Demorats from claims arising out of your field participation.

Third‑Party Processors. Paid features and donations may be processed by third parties (e.g., Patreon, Stripe, PayPal, Shopify). Their terms and privacy policies govern those transactions.

‍Auto‑Renewals. If you purchase a subscription, it may renew automatically at the then‑current price unless you cancel before the renewal date. You can cancel through the platform where you purchased.

‍Refunds. You may request a refund within 7 days of purchase for unused Services. Physical goods follow the Merch policy below.

‍Chargebacks. We reserve the right to dispute chargebacks and to suspend access if payment is reversed.

‍Taxes. Prices exclude taxes unless stated. You are responsible for applicable taxes, duties, and fees.

Orders & Fulfillment. Orders are offers to buy; we may accept or cancel at our discretion (e.g., stock, fraud review, pricing error). Risk of loss transfers upon delivery to the carrier.

‍Shipping. Estimated delivery dates are not guaranteed. International orders may incur customs fees.

‍Returns. Final sale except for defective items; contact support within 14 days.

‍Counterfeits. We are not responsible for third‑party counterfeit goods.

Some Services involve open‑source software and public repositories. By submitting code, documentation, or other contributions, you agree your submissions may be licensed under the project’s applicable open‑source license(s) and/or any Contributor License Agreement (CLA) we specify.

Review repository‑specific terms before contributing.

Our Rights. The Services, including logos, marks, text, graphics, software, and design elements (“Demorats Content”), are owned by Demorats or its licensors and are protected by IP laws. Except for the limited rights expressly granted, no licenses are granted by implication or otherwise.

‍Trademarks. “Demorats,” our logos, and other brand elements are trademarks of Demorats. Do not use our marks without written permission.

‍DMCA/Report IP Infringement. If you believe content infringes your copyright, submit a notice and CC our Copyright Department: mail@demorats.org

‍Your notice must include all required elements under 17 U.S.C. §512(c)(3).

We may remove content and, for repeat infringers, terminate accounts.

The Services may link to or integrate with third‑party websites, tools, or platforms (e.g., Discord, GitHub, X/Twitter, Patreon, etc.).

We do not control and are not responsible for third‑party services.

Your use is subject to those third parties’ terms and privacy policies.

We may offer experimental, beta, or AI‑assisted features that can change, break, or be withdrawn at any time.

Outputs may be inaccurate or incomplete. You are responsible for verifying information before relying on it.

Do not use such features where failure could result in harm.

By using the Services, you consent to the practices described there.

To the fullest extent permitted by law:

The Services are provided “AS IS” and “AS AVAILABLE.”

We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.

We do not warrant uninterrupted, secure, or error‑free operation.

We are not responsible for User Content, third‑party services, or real‑world activities you choose to undertake.

Nothing in the Services constitutes legal, medical, security, or other professional advice.

To the maximum extent permitted by law, Demorats and its affiliates, officers, employees, agents, partners, suppliers, and licensors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising from or related to your use of (or inability to use) the Services, even if advised of the possibility of such damages.

Our aggregate liability for all claims relating to the Services shall not exceed the greater of US $100 or the amount you paid to us in the 12 months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations; in such cases, the above limitations apply to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless Demorats and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your User Content; (c) your violation of this Agreement; or (d) your violation of any law or third‑party right.

Please read this section carefully. It affects your rights.

‍Informal Resolution. Before filing a claim, you agree to try to resolve the dispute informally by contacting us at [mail@demorats.org]. If we cannot resolve it within 30 days, either party may initiate arbitration as described below.

‍Arbitration. Any dispute, claim, or controversy arising out of or relating to the Services or this Agreement that cannot be resolved informally will be determined by binding arbitration administered by [JAMS/AAA] under its applicable rules. The seat of arbitration will be [Phoenix, Arizona, USA], and the language will be English.

‍Class‑Action Waiver. Arbitration will be conducted on an individual basis only. You and Demorats waive the right to a jury trial and to participate in a class, collective, or representative action.

‍Opt‑Out. You may opt out of arbitration by sending written notice to [mail@demorats.org] within 30 days of first accepting these Terms.

‍Small Claims. Either party may bring an individual action in small‑claims court in [Maricopa County, Arizona] if the claim qualifies.

‍Injunctive Relief. Either party may seek temporary or preliminary injunctive relief in court to protect its rights pending arbitration.

If arbitration is not enforceable for a particular claim, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in [Maricopa County, Arizona].

This Agreement is governed by the laws of the State of Arizona, without regard to conflict of law principles, except where preempted by federal law or required otherwise by local consumer laws.

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason or no reason, including violations of this Agreement.

Upon termination, your right to use the Services ceases immediately, but sections that by their nature should survive (e.g., licenses, disclaimers, limitations, indemnities, dispute terms) will survive.

We may modify, suspend, or discontinue all or part of the Services at any time.

We are not liable for any change that affects features, availability, or your content, subject to applicable law and any specific paid‑service commitments.

By providing contact information, you consent to receive service notices and administrative messages (including by email or, if applicable, SMS).

You can opt out of non‑essential marketing messages.

‍Carrier or platform fees may apply.

You are responsible for complying with local laws when accessing the Services from outside the United States, including data protection and speech/assembly regulations.

You represent that you are not located in, under the control of, or a national/resident of any country or person subject to U.S. embargoes, sanctions, or export restrictions.

You agree to comply with all applicable export control and sanctions laws.

You may not assign or transfer this Agreement without our prior written consent. We may assign our rights and obligations to an affiliate, successor, or acquirer.

This Agreement constitutes the entire agreement between you and Demorats regarding the Services and supersedes prior understandings.

If any provision is held invalid, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.
